1.3. By accessing and navigating this Website, the individual (hereinafter the “User“) confirms they are of legal age and possess the legal capacity to enter into binding contracts. If you do not meet these requirements, you must cease using this Website immediately.

2. Scope and Purpose

2.1. These conditions govern the use of the Website and the electronic purchasing of tickets, tours, and access rights (hereinafter “Services“) offered by Szilkatours. 2.2. Using this Website or purchasing any Service implies your full and unreserved acceptance of these Terms and Conditions, our Privacy Policy, and our Cookie Policy. If you do not agree with any part of these documents, you should not proceed with any purchase or use of the site. 2.3. The User is responsible for the custody of any passwords provided. 6.5. Offensive, racist, xenophobic, or illegal comments/content posted by Users will be removed immediately.

7. Anti-Spam Policy

7.1. Users may not harvest email addresses from this Website for the purpose of sending unsolicited commercial communications (SPAM).

8. Limitation of Liability

8.1. While we strive to keep the Website operational, Szilkatours is not liable for interruptions due to technical faults, third-party failures, or maintenance. 8.2. Szilkatours is not liable for damages caused by viruses or malware that may infect the User’s device during navigation.

9. Booking and Fulfillment Process

To finalize a purchase, the User must affirmatively accept the Terms and Conditions, Cancellation Policy, and Ticket Delivery Policy via a checkbox or confirmation button. Without this acceptance, the contract is not valid.

9.1. Validity: Bookings are subject to acceptance by Szilkatours and the availability of the requested tickets/services.

9.2. How to Book:

  1. Select the activity, date, time, and number/age of participants.
  2. Provide the required personal details (Full Name, Phone, Email).
  3. Complete payment via the secure gateway.
  4. Receive a confirmation email (Contract).

9.3. Mandatory Data Requirement: To issue nominative tickets, the User must provide the full names of all participants. Failure to provide accurate data may result in the inability to issue tickets. In such cases, Szilkatours accepts no liability, and no refund will be issued.

9.4. Ticket Delivery Policy (IMPORTANT):

9.5. User Responsibility: If the User provides an incorrect email address or fails to check their SPAM folder, the booking remains valid and non-refundable.

11. Pricing Structure

11.1. What is included: Our prices are comprehensive. They cover the cost of the admission ticket plus a service fee. This fee includes:

11.2. Pricing Display: Prices are final, including taxes, and are displayed per person (unless stated otherwise for private groups). 11.3. Errors: In the event of a manifest pricing error, Szilkatours reserves the right to cancel the booking and refund the User.

12. Cancellation and Refund Policy

12.1. Non-Refundable Services (Tickets & Dated Tours) In accordance with EU Directive 2011/83/EU, Article 16(l), the right of withdrawal does not apply to leisure services provided on a specific date or period.

12.2. Refundable Services (Transfers/Services without tickets) For services that do not include entrance tickets:

12.3. Claims regarding delivery: Disputes initiated because a ticket was not received before the 24-hour delivery window (defined in Clause 9.4) will be rejected, as the User agreed to this delivery timeframe.

13. Access Rules and User Obligations

13.1. Nominative Tickets: Tickets are personal. ID may be required at the entrance. 13.2. Data Submission Deadline: Essential participant data must be submitted within 30 minutes of purchase. Late submission releases Szilkatours from the obligation to guarantee availability or provide a refund. 13.3. Resale: Commercial resale of our tickets is prohibited. 13.4. Modifications: Names, dates, and times cannot be changed once the booking is confirmed.

15. Applicable Law and Jurisdiction

15.1. These Terms and Conditions are governed by the laws of Slovakia. 15.2. In the event of any dispute arising from the interpretation or execution of these terms, the parties submit to the exclusive jurisdiction of the courts located in Slovakia, unless applicable consumer protection law mandates otherwise.
